Preamble

These Terms of Use and Sale (TOU/S) govern all interactions between the Nossetssik Dance Company association, its members, and any user or tenant of the dance studio located at 13 rue du Faubourg Saint-Jaumes, 34000 Montpellier, as well as the use of the association’s website. Any booking or use of the studio implies full, complete, and unconditional acceptance of these terms. Their purpose is to ensure the proper operation of the studio, the safety of users, and the protection of the association’s interests by preventing any abusive behavior, non-compliance, or inappropriate use of the premises and services.

Article 1 – Association Identification

Nossetssik Dance Company is an association governed by French law of July 1, 1901, with its registered office at 13 rue du Faubourg Saint-Jaumes, 34000 Montpellier, France, registered under RNA number W343029627. The publication manager is Mateus Tesson, President. The association can be contacted at info@nossetssik.com or by phone at +33 4 67 72 16 20. The website is hosted by Wix.com Ltd, 40 Namal Tel Aviv St., Tel Aviv 6350671, Israel.

Article 2 – Acceptance of TOU/S and Proof

Access to the studio and bookings via the website are conditional upon explicit acceptance of these TOU/S, confirmed by checking a box during the booking process. This acceptance constitutes a binding contract and a timestamped proof of agreement, retained by the association. Access will not be granted if these conditions are not validated. These TOU/S prevail over any prior or subsequent verbal or written communication, including emails, messages, or agreements, preventing any dispute based on informal “practices” or communications.

Article 3 – Booking, Payment, and Regularization

Booking a time slot at the studio does not constitute a guaranteed right and is only confirmed once all payments and applicable fees have been fully settled. Any delay or non-payment authorizes the association to refuse access, suspend the booking, and require full payment before any future booking, including for slots already paid. All cancellations, regardless of reason, are final and constitute a waiver of the right to access the reserved slot. Any subsequent access requires a new booking request, acceptance of the current TOU/S, and full payment. Overrunning the reserved time slot is billed at €5 per quarter-hour started, and these fees must be paid before any new booking. The association reserves the right to refuse future bookings in case of repeated overruns or failure to comply with the terms. Any payment made, including disputed, conditional, or unacknowledged payments, constitutes full regularization and does not suspend the application of these TOU/S.

Article 4 – Access Conditions and Membership

Access to the studio is reserved for association members, except for individuals acting in a professional capacity with valid professional liability insurance, in which case only the professional person must be a member. The maximum capacity is 19 people, and any undeclared individual may be denied access or subject to a rate adjustment. The association reserves the right to refuse access to anyone who does not comply with these terms or exhibits abusive, dangerous, intimidating, or disrespectful behavior.

Article 5 – Cancellations, Rescheduling, and Time Slots

All bookings are strictly non-refundable. Rescheduling requires express approval from the association and is subject to the following deadlines: up to 48 hours before the slot, rescheduling is possible without fees; between 48 and 24 hours, rescheduling is allowed for a €5 fee; less than 24 hours, no rescheduling is possible. Any cancellation results in the permanent loss of access to the slot, and any subsequent access requires a new booking request with full payment.

Article 6 – Participation in Workshops, Open Classes, and Occasional Activities

Participation in workshops, open classes, and any educational or artistic activities offered by Nossetssik Dance Company, whether regular or occasional, constitutes voluntary participation in an activity organized by the association and does not constitute a rental or individual use of the studio.

All participation in an open class or workshop is strictly non-refundable, regardless of the reason, including in cases of absence, personal impediment, or late withdrawal. No rescheduling, credit, or compensation may be requested.

To ensure the smooth running of classes and to allow proper pedagogical organization, anyone wishing to participate in an open class or workshop must notify the association of their intention to participate at least twenty-four (24) hours before the scheduled class. The association reserves the right to refuse any participation announced after this deadline or in case of full capacity, without this giving rise to any compensation.

Participants in classes, workshops, and open classes have no right to use the studio outside the scope of the activity supervised by the association. Accordingly, all rules relating to studio rental conditions do not apply to participants, who have no control over the schedule or occupancy of the premises.

Participation in classes implies full and unconditional acceptance of these Terms and Conditions (TOU/S) as well as the Studio Nossetssik Internal Regulations. Any behavior contrary to the rules, the proper conduct of activities, or good faith may result in immediate exclusion of the participant, without refund or recourse.

Article 7 – Studio Use and Rules

Users agree to respect the premises, equipment, and facilities, to keep the studio clean and tidy, and to behave respectfully toward others. The following are strictly prohibited: wearing street shoes, consuming food or drink (except water), using creams or oils that may damage the floor, smoking, creating noise disturbances, or interfering with other users. Violations of these rules may result in immediate termination of the booking, billing for damages caused, and refusal of future bookings.

Unless expressly stated in writing, any booking of the studio does not grant any exclusive right to use the premises. The association, its management, or its representatives retain the right to be present on-site, to access common areas, and to carry out their professional activities, even during a reserved time slot.

Article 8 – Specific Prohibitions and Abusive Behavior

Any attempt to interfere with the reservations of other users, including contacting them to influence or cancel their bookings, is strictly prohibited. Any intimidating, accusatory, intrusive, or abusive behavior, or any unauthorized image or audio/video recording, will result in immediate termination of the session and exclusion without refund. Abusive or bad-faith use may lead to immediate suspension of access to the studio.

Article 9 – Liability

The tenant is responsible for all material and bodily damages occurring during studio use. The association disclaims all liability for injuries, accidents, theft, or loss, except in cases of intentional fault. Any dispute concerning studio use is governed by French law and may be subject to amicable mediation prior to any legal action. The tenant bears the burden of proving compliance with all obligations under these TOU/S.

Article 10 – Website Use

The website of Nossetssik Dance Company is primarily intended to present the association’s activities, provide information to users, and manage the booking of studio time slots. Accessing and using the website implies full and unconditional acceptance of these Terms of Use and Sale. Each user agrees to use the website in compliance with the law, these Terms, and in good faith.

It is strictly prohibited to use the website for abusive, fraudulent, or conflicting purposes, or in any manner contrary to these Terms, including attempting to disrupt the booking system, manipulate time slots, harass, or contact other users or members without authorization. Any unauthorized access, modification, interception, or alteration of the site’s content or functionalities shall be considered a serious violation.

Each user is responsible for the use of their account, login credentials, and any action performed through their access. Sharing login credentials with third parties is strictly forbidden. Any information communicated, published, or transmitted through the website must be accurate, complete, and compliant with applicable rules. The association reserves the right to suspend, restrict, or block access to the website for any user who fails to comply with these obligations, without prior notice or compensation.

Nossetssik Dance Company also reserves the right to modify, update, or temporarily or permanently suspend access to all or part of the website, its functionalities, or the Terms of Use and Sale, without this giving rise to any compensation. Users are responsible for regularly reviewing these Terms to remain informed of any changes.

Finally, all personal data collected via the website are processed in accordance with the Privacy and Cookie Policy and applicable regulations, including GDPR. Users have the right to access, rectify, delete, restrict, object to, and port their personal data. Using the website implies acceptance of these conditions and of the data processing in accordance with the policy in force.

Article 11 – Intellectual Property

All content on the website and in the studio, including texts, images, videos, graphics, logos, music, and choreography, is the exclusive property of the association. Any reproduction, representation, modification, or unauthorized use is strictly prohibited and may result in legal action.

Article 12 – Governing Law and Jurisdiction

These TOU/S are governed by French law. Before any legal action, an attempt at amicable mediation is mandatory. In the event of a persistent dispute, the competent court is that of the association’s registered office.
